This privacy notice (“Privacy Policy”) discloses the privacy practices for Novadontics, LLC, a California limited liability company (“Novadontics”/“we”/“our”/“us”) to inform visitors and users (“you”/“your”) of our use of any data we may collect from your use of our websites, including but not limited to www.Novadontics.com, www.NovadonticsFAD.com and all affiliated websites and applications owned and operated by us (collectively, the “Novadontics Site”). We also collect and use Personal Data as a service provider on behalf of a dentist or dental specialist, professional, provider, organization, or agent or affiliate thereof (collectively, “Dental Providers”) who have registered and/or subscribed to our services (a “Novadontics FAD Provider”). We may also collect Personal Data of individuals from users who utilize our services and the Novadontics Site (i.e., when someone is booking a dental appointment on behalf of another). Please do not share Personal Data of other individuals with us unless you have their permission to do so.
How We Use and Share Personal Data
We may use Personal Data to perform our services and to communicate with you about our company, products, or services, including for scheduling appointments, billing for services, sending requested information or responding to your inquiries or other feedback. By using our services and the Novadontics Site, you acknowledge and agree that we will be transmitting certain of your Personal Data electronically, and that we may use some of your identifying Personal Information (name, phone number, email and age), to send you additional communications related to our service or the service of Novadontics FAD Provider.
We may also use your Personal Data to customize and tailor your use of our services and to manage and improve the Novadontics Site and our services, products, business, customer outreach, advertisements, events, and promotions. We may also use your Personal Data to maintain the security and integrity of the Novadontics Site and our service, systems, operations, and products and to prevent and address fraud, unlawful access, and breach of our policies and terms.
Your Personal Data may also be used by us to comply with a contractual, legal or regulatory obligation, contractual obligation or to as is necessary to protect someone’s life or to pursue legal matters.

When we receive certain health information, we may do so as a “business associate” of a Novadontics FAD Provider under an agreement that, among other things, generally prohibits us from using or disclosing health information in ways that are not permissible by the Novadontics FAD Provider itself, and requires us to implement certain measures to safeguard the confidentiality, integrity, and availability of this type of information. Applicable business associate agreements generally permit us to use and disclose your personal health information (1) to perform functions or activities on behalf of, or provide services to, the Novadontics FAD Provider, in connection with their role in underwriting dental benefit coverage and administering dental benefit programs and claims, or as otherwise permitted or required by law including HIPAA; (2) for our proper management and administration or to fulfill its legal responsibilities; (3) to perform data aggregation services in order to provide analysis relevant to the health care operations of a Novadontics FAD Provider; or (4) to create de-identified data. Where your dental coverage benefits are underwritten or administered by a Novadontics FAD Provider, we may collect, use, and disclose your personal health information consistent with the HIPAA Notice of Privacy Practices pertaining to your dental plan.

How We Keep Your Personal Data Secure
We take precautions to protect your information. When you submit sensitive information via the Novadontics Site, your information is protected both online and offline. Wherever we collect sensitive information (such as your payment data, protected health information and electronic health records), that information is encrypted and transmitted to us in a secure way, and your Personal Data is stored on secure servers that are not accessible by third parties. Except as otherwise provided in this Privacy Policy, we keep your Personal Data private and will not share it with third parties other than those disclosed in this Privacy Policy or unless necessary in special cases such as: (1) to comply with legal requirements or processes; (2) to protect our rights or property; or (3) to enforce our rights under contract or applicable law. We know how important it is to keep sensitive personal information secure. As health care technology advances, cybersecurity becomes increasingly essential. This is why Novadontics® has taken reasonable measures to strengthen our cloud-based datacenter and protect it against unauthorized access and data breaches. Novadontics® uses a HIPAA-certified cloud datacenter that is protected by physical security measures that combine high-technology and traditional security measures to protect sensitive personal information. The facility is carefully monitored for potential threats by expert cybersecurity personnel. All cloud data is protected by multiple layers of security, including redundant firewalls. Daily backups are performed, and data is stored in a secure off-site location, allowing for data recovery in the case of a catastrophic event or natural disaster.
How We Update This Privacy Policy
We reserve the right, at any time and without notice, to add to, modify, or update this Privacy Policy. Such changes will be posted on the Novadontics Site and will be effective immediately upon posting. If the changes are significant, we may provide a more prominent notice.
Children Information
The Novadontics Site is intended for general audiences and are not directed to children under 18. We do not knowingly collect Personal Data from children under 18 without receiving parental or guardian consent. If you become aware that a child has provided us with Personal Data without parental or guardian consent, please contact us. If we become aware that a child under 18 has provided us with Personal Data without parental or guardian consent, we will take reasonable steps to obtain such parental or guardian consent, or remove such information and terminate the child’s account (if applicable).
California Residents: Your California Rights
Under California Civil Code section 1798.83, California resident have a right to request a list of all third parties to which we, during the immediately preceding calendar year, have disclosed certain Personal Data for direct marketing purposes. Except as it relates to our rending of services to Novadontics FAD Providers, we do not share Personal Data about you with any third parties for their own marketing purposes. We are only required to respond to such a request once during any calendar year. To make such a request, you should contact us as listed below. Please be aware that not all information sharing is covered by the California privacy rights requirements and only information sharing that is covered will be included in our response.
We do not currently actively respond to “Do Not Track” browser signals or mechanisms that indicate a request to disable online tracking of individual users who use our sites and services.
In general, we use these technologies to remember you when you return to our sites, to understand and analyze trends, to monitor usage and administer the sites, to learn about user behavior on the sites and gather demographic information about our user base as a whole, to customize content or offers on our sites and through our services, and to conduct research to improve our sites, content, and services.
